Orange County Irvine Crime Rate Rose 42 Percent in 2009

IRVINE, Orange County - According to Orange County Register that violent crime in Irvine has increased 42 percent in 2009. However, Irvine still remains as the safest city nationwide. The report also lists Fullerton with violent crime increase of 40 percent, and Costa Mesa crime increases by 18 percent.

The statistics showed that Irvine has been holding the title of the safest city nationwide for five years. The crimes reported increased in Irvine include crimes such as white collar crimes, murder, homicide, assault and battery, grand theft, shoplifting, domestic violence, rape, robbery, aggravated assault, fraud and embezzlement and others.
The report also shows that there is a drop of crimes in Orange County cities including Newport Beach, Santa Ana, Orange, Garden Grove, Anaheim, Huntington Beach, and Westminster.

Los Angeles Drunk Driver charged with murder

Orange County Register reports that a Los Angeles drunk driver who killed two young Rancho Cucamonga women Saturday in La Verne was charged with murder. Alan Michael McConnell, of Covina, was charged with two murder counts on Tuesday. He was also charged with driving while intoxicated, hit-and-run and driving on a suspended license. McConnell crashed into another car and fled the scene. One woman was killed at the scene and the other seriously injured.

Due to the prior felony drunk driving conviction, McConnell was charged with murder this time instead of vehicular manslaughter. It is clear that the prior convictions on McConnell didn't change his driving behavior. After the previous convictions, he should have learnt that it is dangerous on the road when he was driving behind the wheels while intoxicated or drunk. However, he chose to do it again and again.

After he got convicted in Orange County, he got on the road and arrested for the same drunk driving offense the following weekend. While awaiting arraignment for that arrest, he crashed a car, allegedly while intoxicated, and two young women died.

Santa Ana Man Convicted of Murder get a new trial

Santa Ana, Orange County - A Santa Ana man who was convicted of first degree murder in 2008 was granted a new trial today. Ruben Oliveros, of Santa Ana, was facing life in prison without the possibility of parole. An Orange county criminal defense attorney brought up a motion for a new trial and stated that the defendant may not have been at the crime scene. The Judge granted a new trial because it seems that there is strong evidence that a jury could give a different verdict.

Co-defendant, Charcas-Fernandez, has pleaded guilty to involuntary manslaughter in this case. Aurelio Saldivar, another defendant, was also convicted of murder in the case.

Orange County Attorney and partners charged with White Collar Crime, Fraud and Grand Theft

SANTA ANA, Orange County - A disbarred Orange County attorney and his two business partners in the loan modification business were charged with a felony count of conspiracy for committing fraud, grand theft and felony counts of grand theft by false pretense. Christopher Lee Diener, Stefano Joseph Marrero, and Terrence Green Sr., of Ladera Ranch, were arrested today for the grand theft and white collar crimes in defrauding over 400 homeowners. The business was under the name of Home Relief Services LLC and US Loan Mod Processing and Diener Law Firm. The business provided service to people who need loan modification and facing home foreclosures.

Los Angeles Man charged with Murder of Huntington Beach girl

According to Los Angeles Times, Los Angeles man Rodney Alcala is facing murder charges for the murders of four Los Angeles women who were sexually assaulted, beaten and strangled 2 years before the death of another woman Samsoe.of Huntington Beach,

12 year old Huntington Beach girl Robin Samsoe disappeared from the beach after she and her friend were asked by a man if he could take their picture. The friend accompanying Samsoe to the beach that day, later identified Rodney James Alcala as the man who took their picture. Alcala was twice convicted for the murder of Samsoe, but those convictions were reversed on appeal due to evidence improperly allowed into evidence. During Alcala's second appeal from his second conviction in 2001, DNA evidence was discovered by LA County Investigators. Alcala pleaded not guilty to the charges.

As stated in California Penal Code Section 187: murder is an act that results in the death of another human being, while California Penal Code Section 189: states 1st Degree Homicide is murder due to some form of deliberation and premeditation. Orange County Brothers get prison for graffiti attack

Orange Couny Register reports that on July 14, 2009, at approximately 2:00am, while walking home the victim noticed 3 unknown persons tagging a wall. The victim shouted to the perpetrators to stop and was subsequently followed by all 5 unknown persons to the southwest corner of McFadden Avenue and Maple Street where he was allegedly surrounded by the 5 individuals and beaten and stabbed. Brothers, Alejandro Duran and Nicolas Duran admitted they were involved in the assault and stabbed the victim twice in the abdomen. A third suspect; a juvenile, Manola Mauricio, stated he was present during the assault and given credit for serving over 200 days in custody; plus three years probation.

As stated in California Penal Code Section 245 (a) (1): Any person who commits an assault upon the person of another with a deadly weapon or instrument other than a firearm or by any means of force likely to produce great bodily injury shall be punished by imprisonment in the state prison for two, three, or four years, or in a county jail for not exceeding one year, or by a fine not exceeding ten thousand dollars ($10,000), or by both the fine and imprisonment. The actions of the Duran brothers fall under this particular code due to the fact that during the beating or assault upon the victim, defendants used a deadly weapon and in this case it was a knife. Four Orange County Men Charged with Murder in the killing of Tustin teen

TUSTIN, Orange County - Four Orange County men were arrested Tuesday for the murder of a Tustin teen who was shot to death on Sun at a house party in Tustin. On Tuesday, Nhem, Pablo Kachirisky Steven Kao, and David Escobar have been arrested and were charged with felony counts of terrorism and murder, with sentencing enhancements.

The enhancements are murder involves a criminal street gang activity, or a firearm which caused the death of another person. Santa Ana man John Saway and Sarith Yin have been arrested for the murder charges. Anaheim resident Belinda Vu, 19, was also arrested Tuesday, but has since been released and no charges are being filed.

Los Angeles Man arrested for the Murder of 84 year old Anaheim woman

Los Angeles - The body of an 84 year old woman was found in her home, a victim of sexual assault, robbery and murder, the Anaheim police reported Sunday. The woman's car had been found in a San Bernardino County grocery store. The suspect, 25 year old Anthony Wade of Los Angeles, allegedly tried to use the victim's stolen credit card when he was apprehended after he became agitated when the clerk would not accept the credit card.

The police went to the home of the victim, Bessie Whyman, to see if she knew the whereabouts of her car and to check on her welfare when her naked body was discovered in the living room of her home. Wade, was transferred to an Anaheim detention center and is expected to be arraigned on charges of first degree felony murder, robbery and sexual assault.

Under California Penal Code Section 187, murder defined as unlawful killing of another human being with the intent of malice. Orange County Man Sentenced to 25 years to life for drowning son

Fullerton, Orange County - A Fullerton man, Gideon Omondi, who was convicted of first-degree murder and attempted murder in 2006, was sentenced to 25 years to life in prison yesterday. Omondi killed his 4-year-old son in the bathtub at his Fullerton Appartment in September, 2006 in order to avoid paying child support. Orange County social workers had been contacted about possible child abuse before his son was killed.

Omondi was a Kenyan student studying at Cal State Fullerton in 2004. Omondi and his wife was divorced and shared custody of their son. On Sunday night in September 2006, he drowned his son Richie. He drove to the Fullerton police station and confessed to the Fullerton police. He pleaded not guilty by reason of insanity, but he was found to be sane in court.

Garden Grove Driver Arrested for Felony DUI Injury

ORANGE, Orange County - A Garden Grove minivan driver, Yonic Patino, was arrested for DUI / driving under the influence which caused injuries of more than 10 people from the Orange County bus in a fetal crash with a sedan.

Patino, is facing charges of felony DUI and driving on a suspended license. He is expected to be taken to the Orange County jail. Orange County Prosecutor Arrested for Domestic Violence

HUNTINGTON BEACH, Orange County - An Orange County high-profile homicide prosecutor was arrested on Christmas day. David Brent and his wife, Roshawn were arrested for domestic violence.

Mr. Brent fought with and punched Roshawn's face. Allegedly, the fight began over a gift. Scared, she called 911. Mr. Brent fled the scene. Both David Brent and his wife were arrested for corporal injury on a spouse. They were transported to Huntington Beach jail. They currently face felony domestic violence charges.

Both parties are charged with California Penal Code Section 273.5 (willful infliction of corporal injury). California law defines a spouse as a former spouse, cohabitant, and the mother or father of a child. Corporal injury refers to a wound, either internal or external caused by serious force. Los Angeles Ex-Executive Convicted in fraud case

Los Angeles, California - Orange County register reports that the CEO of Homestore Inc, has pleaded guilty for committing stock fraud and white collar crimes on Tuesday. Stuart Wolff, the CEO and chairman of the real estate listing firm is sentenced in April for investment and securities fraud. He is facing up to five years in prison. There are also 11 other defendants involved in this case.

Orange County and Los Angeles Apple Computer Theft Crimes widen

Orange County, California - There were 15 theft and burglary cases reported in Orange County, Los Angeles, Riverside. Three Los Angeles men were arrested for the theft case on Dec. 29. A sting has been set up in Mission Viejo, and three men followed an undercover police and broke into his car and stole his computer.

The three men, Garzon David, Louis Lopez, and John Rodriguez have been charged with felony counts of burglary and grand theft. They have been charged with 28 counts of second-degree burglary, unlawful tampering of a vehicle and grand theft.

Authorities of Orange County will further investigate the case and work with Los Angeles for this large theft ring. Police in Orange County has been noted of more theft and burglary cases at the holiday season. Newport Beach, Costa Mesa, Irvine and Orange County have reported the similar crimes during the holiday.

Garden Grove fatal DUI crash

Garden Grove, Orange County - A Huntington Beach man has been arrested this morning by GARDEN GROVE Police for DUI caused crash. He was driving under the influence during the accident which killed 22-year-old passenger. The driver was driving intoxicated and is facing charges of felony vehicular manslaughter and driving under the influence.

The drunk driving driver, Vicente Garcia, was arrested on suspicion of felony driving under the influence (felony DUI), vehicular manslaughter and driving without a driver's license, according to Garden Grove Police Department. After the accident happened, they were sent to the hospital for treatment. The passenger was announced dead in Orange hospital. The DUI drunk driver was taken to the Orange County Jail.

Irvine and Pasadena prostitution ring busted

IRVINE, Orange County - Pasadena policeman raided a few apartments in Pasadena and Irvine on Dec. 16. Several prostitutes have been arrested. Police also found $10,000 in cash, jewelry and three cars. The four women have been charged with misdemeanor prostitution.

Temple City man and woman, Thanh Ly and Li Chen, have been arrested on operating millions of dollar prostitution business from upscale apartments in Irvine and Pasadena. Both of them have been charged with felony pimping and pandering.

California Penal Code Section 647(b) Prostitution and Solicitation, it includes solicitation, or exchanging sexual services for money. The penalties for prostitution and solicitation are severe, depending on the circumstances of the charge. It can carry harsh punishment, including jail time, probation and fines. Orange County Prosecutor arrested for domestic violence

HUNTINGTON BEACH - David Brent, of Huntington Beach, was arrested on Christmas for domestic violence. He is an Orange County high-profile homicide prosecutor. His wife, Roshawn, also was also arrested for domestic violent in the fight over a gift. They are facing felony domestic violence charges.

Brent, a head of homicide unit at the Orange County District Attorney's office, fought with his wife and punched his wife in the face. She called 911 for the domestic violence. David Brent fled the scene. Both David Brent and his wife were arrested for corporal injury on a spouse and were taken to the Huntington Beach Jail.

The Murder of Los Angeles Boy shocks Azusa city

Los Angeles, California -The victim, Jesse Valencia, of Los Angeles, was shot Friday afternoon as he played with a remote control. According to the LA County District Attorney's Office, Richard Joseph Gomez (21) and Matthew Loza (20) were each charged with one count of murder.

The complaint alleges Loza used a .30 rifle to commit the crime. It also charges Gomez as an accessory. Purportedly, Gomez tried to hide Loza so he would not be arrested.

At this point, police have not stated whether the shooting was an accident or intentional. This case is still under investigation.

Orange County DUI Arrest at New Year

According Orange County Register that there were 20 reported death due to the traffic accidents in California during the New Year's holiday. The drunken-driving arrests number increased over 30 percent in California, however, the deaths were not all caused by DUI or driving under the influence. California highway patrol had 898 arrests for DUI arrest and driving under the influence on New Year's Eve. .

Under Cal. VEH. Code ยง 23153. . . . ." It is unlawful for any person, while under the influence of any alcoholic beverage . . . . to drive a vehicle and concurrently do any act forbidden by law, or neglect any duty imposed by law in driving the vehicle," which act could result in bodily injury to another person.

The drunk driving or DUI did not result in any deaths over New Year's, but the number of incidences of drunk driving rose over 30%. The DUI or DWI charge can be considered a misdemeanor or felony, depending on circumstances. A hit-and-run injury DWI might be a felony, for instance; whereas a first time no-harm-done DUI might be a misdemeanor.

Orange County Man Convicted of Grand Theft and Fraud for stealing from Elderly Investors

SANTA ANA, Orange County - A San Juan Capistrano man, Jeffrey Butler, was convicted of 700 felony counts of white collar crime, grand theft and investment fraud for stealing from elderly investors. He bilked 124 investors of over $11 million through a Ponzi scheme. He was sentenced to 90 years and eight months in prison. The trial was the longest trial in Orange County.

Butler worked with elderly clients on their wills and trusts and offered them unrealistic investment returns. He stole $11.4 million through Ponzi scheme in which money paid to earlier investors by later investors.

Anaheim Driver not Held Responsible for Tragic Death of Nine-Year Old

Santa Ana, Orange County - A recent investigation into the death of a 9-year-old boy has ended with the conclusion that the driver of the vehicle which struck and killed the 9 year-old-boy, Nicholas Vela Mortley, was not criminally responsible and would not be issued a citation.

According to the facts offered by The Orange County Register, Nicholas Mortley was riding his bicycle home from school when he was hit by a raised pickup truck in Anaheim on December 3, 2009. According to the police, the truck driver was headed west on Orangewood and made a full stop at the stop sign. The driver of the truck did not see the child (evidently, the truck in question was raised 30 inches off the ground, which met the legal limits).

Under California Penal Code Section 191 and Penal Code Section 192, Gross Vehicular manslaughter is a serious crime causing the death of another person due to illegal driving, including negligence, drunk driving or reckless driving.

California Vehicular manslaughter can be charged as a misdemeanor or a felony depending on the circumstances and seriousness of the crime. Gross negligence can be charged as a misdemeanor or felony; but if it is involved with the death of a person, it usually is charged as felony.

Orange County Bank Robbery by "Blue Note Bandit"

Mission Viejo, Orange County - A bank robbery occurred in Mission Viejo which authorities are attributing to the lone operative known to investigators as the "blue note bandit."

According to The Orange County Register, tellers at La Jolla Bank identified the man from photo stills taken of the "blue note bandit" from other bank robberies. The "blue note bandit" is believed to have also held up banks in Aliso Viejo, Costa Mesa, Tustin, Irvine, Laguna Hills and San Juan Capistrano and Lake Forest.

California Penal Code Section 211 identifies Robbery as "the felonious of personal property in the possession of another, from his person or immediate presence, and against his will, accomplished by means of force or fear."
