Charges dropped for a Newport Beach man shooting and killing another man for self-defense

Rancho Santa Margarita, Orange County - Santa Ana felony crime Defense attorney Michael Guisti recently commented and discussed about a case on the crime news concerning a Newport Beach man was charged with Orange County murder charge but the case was later dismissed for self-defense.

Brain Scott Ostrom, 51 years, a pilot of Newport Beach, shot and killed a bail bondsman, Dean P. Maldonado, earlier this year over a love-triangle gone bad. After a 5-month investigation, the prosecutors decided that there was insufficient evidence that Ostrom was criminally liable in order to prove his guilt beyond a reasonable doubt. Therefore, Ostrom will not be charged in the case.

According to Irvine Criminal Defense lawyer and Santa Ana criminal attorney, Michael Guisti, one potential charge that could have been made would be Voluntary Manslaughter. California Penal Code 192 (a), Voluntary Manslaughter is a killing upon a sudden quarrel or heat of passion. Voluntary Manslaughter is seen as a lower case of murder because the defendant commits the crime out of an unexpected burst of anger instead of premeditation.

According to the California criminal attorney, who has many years of experience in manslaughter and other related felony charges such as voluntary manslaughter, vehicular manslaughter, involuntary manslaughter, homicide, murder, states that the key point here is the proof of "heat of passion" out of plaintiff's or the victim's provocation.

For example, finding your spouse or beau in bed with another, defendant is violently robbed by a perpetrator, murder of a family member are considered sufficient provocation. However, mere name calling, staring, mad dogging or looking by another are insufficient provocation and, thus the unusual killing followed will usually be considered murder.

The California felony crime defense lawyer further explains that Voluntary Manslaughter is a severe crime after murder. A defendant can face up to 11 years of imprisonment if convicted. If it is a third strike judging from the defendant's prior criminal history, the defendant may face 25 years to life imprisonment.

Allegations of stock-trading irregularities could result in many arrests

An article from the Tribune Washington Bureau caught the eye of Michael Guisti concerning of increased investigations regarding allegations of insider trading and other stock-trading irregularities that could bring criminal charges or monetary fines against many by and large Wall Street executives and investors according to a Washington official. This type of investigation has been ongoing for several years and is likely as a result in prosecution of traders "around the country."

Are we seeing a new trend in white collar crime involving illegal insider trading and other stock-trading irregularities? Is it due to the recessionary times? Is it due to high unemployment? Is it due to heightened speculation in the real estate market involving inflationary appraisals and high foreclosures nationwide? According to Newport Beach fraud lawyer Michael Guisti, it is unknown why fraud, and white collar crimes including, but not limited to, bank fraud, wire fraud, securities fraud, identify theft and insurance fraud have increased. Understand that the number of filing of similar crimes have gone up from year to year.

As one U.S. attorney was quoted "Disturbingly, many of the people who are going to such lengths to obtain inside information for a trading advantage are already among the most advanced, privileged and wealthy insiders in modern finance. But for them, material nonpublic information is akin to a performance-enhancing drug that provides the illegal 'edge' to outpace their rivals and make even more money." Greed is the first word that comes to mind which describes the senseless act within which to be acted upon by these professionals.

Many professionals affected include consultants, investment bankers, hedge-fund and mutual fund traders and analysts among others.

Irvine Fraud lawyer Michael Guisti believes that a number of people to be arrested could rise to double digits in southern California.
