Woman Accused of Throwing Infant Off Building

Santa Ana, Orange County - An Orange County woman has been arrested for attempted murder on suspicion of throwing her 7-month-old son from the fourth floor of a parking structure at Children's Hospital of Orange County, leaving him with major injuries, according to Orange Police.

[UPDATE: Wednesday: The infant has died and the Orange County District Attorney has said charges would be elevated to murder, which carries a possible penalty of 25 years to life in state prison.]

Orange Police report the mother has postpartum depression and was hospitalized in June for such depression.

It's reported that the suspect's criminal record shows no previous reports of child abuse, assault, battery or domestic violence.

Santa Ana criminal defense attorney Michael L. Guisti explains murder is always a very serious case, and given the suspect allegedly is suffering from depression it's possible the suspect could be found incompetent to stand trial.

Guisti explains that for somebody to be found incompetent to stand trial they must lack a rational understanding of the charges against them, an understanding of the proceedings of their trial, or the ability to participate in their own defense.

Santa Ana criminal lawyer Guisti stresses that if this suspect is found incompetent to stand trial it's not a "get out of jail free card," but rather the suspect would likely be sent to a secure state medical or psychiatric facility to receive treatment until she is able to stand trial.

Once the suspect is deemed competent to stand trial the court will proceed with its case, according to Guisti.

Guisti says it's possible the suspect's attorney may try to use the insanity defense.

Now the difference between being found incompetent to stand trial and an insanity plea, according to Guisti, is an insanity plea is when somebody claims they don't know the difference between right and wrong at the time they committed the crime.

Guisti says despite popular belief insanity pleas are actually very hard to come by and if an insanity plea is accepted this too isn't a "get out of jail card," but rather the judge usually sentences the suspect to a secure state medical facility for a period of time, and every few years or so there is a hearing to determine the mental condition of the suspect.

If you're facing charges stemming from a domestic violence case, attempted murder case or an assault with a deadly weapon case please call the Law Offices of Michael L. Guisti at 714-530-9690 so we can review your case.

Charges dropped for a Newport Beach man shooting and killing another man for self-defense

Rancho Santa Margarita, Orange County - Santa Ana felony crime Defense attorney Michael Guisti recently commented and discussed about a case on the crime news concerning a Newport Beach man was charged with Orange County murder charge but the case was later dismissed for self-defense.

Brain Scott Ostrom, 51 years, a pilot of Newport Beach, shot and killed a bail bondsman, Dean P. Maldonado, earlier this year over a love-triangle gone bad. After a 5-month investigation, the prosecutors decided that there was insufficient evidence that Ostrom was criminally liable in order to prove his guilt beyond a reasonable doubt. Therefore, Ostrom will not be charged in the case.

According to Irvine Criminal Defense lawyer and Santa Ana criminal attorney, Michael Guisti, one potential charge that could have been made would be Voluntary Manslaughter. California Penal Code 192 (a), Voluntary Manslaughter is a killing upon a sudden quarrel or heat of passion. Voluntary Manslaughter is seen as a lower case of murder because the defendant commits the crime out of an unexpected burst of anger instead of premeditation.

According to the California criminal attorney, who has many years of experience in manslaughter and other related felony charges such as voluntary manslaughter, vehicular manslaughter, involuntary manslaughter, homicide, murder, states that the key point here is the proof of "heat of passion" out of plaintiff's or the victim's provocation.

For example, finding your spouse or beau in bed with another, defendant is violently robbed by a perpetrator, murder of a family member are considered sufficient provocation. However, mere name calling, staring, mad dogging or looking by another are insufficient provocation and, thus the unusual killing followed will usually be considered murder.

The California felony crime defense lawyer further explains that Voluntary Manslaughter is a severe crime after murder. A defendant can face up to 11 years of imprisonment if convicted. If it is a third strike judging from the defendant's prior criminal history, the defendant may face 25 years to life imprisonment.

How can an experienced Orange County criminal defense attorney help you with your manslaughter defense, homicide defense or Murder defense in Orange County, Los Angeles, San Bernardino, Riverside throughout California?

Two Orange County Teens Suspected of Robbery and Attempted Murder

Cypress- Alonzo Gamez of Cypress in Orange County and his 17 year old friend are suspected of robbery and attempted murder. It is alleged that Gamez and the other teen robbed a man that was working in his garage. They took the victim's wallet and then ran. The victim then started to chase after them. This is when one of the suspects shot at him. The victim was not hurt. The 17 year old suspect was arrested at the scene, Gamez as found later.

In Orange County and all over Southern California, juvenile crimes are treated differently then adult charges. Robbery can be defined in the California Penal 211 and it states that robbery is the taking of another's property through force or fear. Murder can also be found in the California Penal Code section 187 and it states that murder is the unlawful killing of another. Usually in juvenile charges, the judge will charge the juvenile as a minor. However if the crime is a violent charge like murder or robbery they can get charged as an adult if the crime was committed by a juvenile that was at least 16 years old.
