Feds Threaten Local Officials on Complying with Medical Marijuana Clinics
Newport Beach, Orange County - In a move by the federal government that has upset owners of medical marijuana clinics the federal government has now threatened local government officials who implement medical marijuana laws could now face criminal charges.
Some cities, including Costa Mesa, Huntington Beach, Santa Ana and Newport Beach, have worked out deals allowing the legal medical marijuana operations in their cities to be taxed, which has been a windfall for local government.
This has also caused confusion and concern among those who can legally use medical marijuana with many patients worried that federal or local authorities will arrest them and they'll be charged with a federal drug crime or California marijuana crime, such as possession, marijuana sales, being under the influence or even use of drug paraphernalia.
It's important to understand and remember, says Santa Ana drug attorney Michael L. Guisti, that however unfair this may be California's medical marijuana law's is in major contrast with the federal government's view of medical marijuana, which still classifies marijuana as a Schedule I drug, which means that the federal government views marijuana as highly addictive and has no medical value.
The rule of thumb, says Guisti, federal laws typically trumps local law.
The issue at hand, explains Guisti, is the Obama Administration noted they would take a hand offs approach to medical marijuana, but then beginning in late 2011 that abruptly changed with the raid of several San Diego area medical marijuana clinics and an announcement by the Justice Department saying they're cracking down on medical marijuana operations.
Just how much of a crackdown the Justice Department plans on California's medical marijuana clinics is unclear, but it is beginning to drive some operations "underground," which could be a problem for these places later on, says Guisti.
Just as well, Guisti goes on to say, for some cities that haven't been too welcoming in having medical marijuana operations in their city, like Lake Forest, those city officials are more than willing to work with the feds to close down medical marijuana operations in their city.
It's very important to note, stresses Guisti, unlike being arrested for a California marijuana charge, if arrested by the Justice Department you'll likely face federal criminal charges, and if convicted you could face several years in federal prison and up to a million dollars in fines.
